Client Contract & Terms and Conditions

This Contract and Terms and Conditions (the "Agreement" or "Terms") is entered into by and between Time 2 Go Travel, LLC ("Company," "Agency," "we," "us," or "our") and the traveler or client ("Client," "Traveler," "you," or "your"). By requesting, approving, paying for, or booking travel services through Time 2 Go Travel, LLC, Client acknowledges that Client has read, understands, and agrees to be bound by these Terms.

1. Introduction

  • Parties Involved: This Agreement is made between Time 2 Go Travel, LLC and Client.
  • Purpose: This Agreement establishes the terms under which Time 2 Go Travel, LLC will provide travel-related services.

2. Role of Time 2 Go Travel, LLC and Scope of Services

Time 2 Go Travel, LLC acts solely as a booking agent and travel advisor for airlines, hotels, cruise lines, tour operators, transportation companies, excursion providers, travel protection providers, and other third-party travel suppliers (collectively, "Suppliers"). Time 2 Go Travel, LLC does not own, operate, manage, or control any Supplier.

All travel services are subject to the Supplier’s own terms, conditions, cancellation policies, refund rules, payment deadlines, and operational requirements, which may differ from those of the Agency.

Time 2 Go Travel, LLC provides travel advisor and booking-related services. Time 2 Go Travel, LLC is not liable for or responsible for any arrangements made independently of Time 2 Go Travel, LLC. Time 2 Go Travel, LLC assumes no responsibility for costs or fees Client incurs for independent arrangements not booked through Time 2 Go Travel, LLC, including but not limited to airline, hotel, excursion, transportation, and travel protection related charges.

If Client makes independent flight arrangements, Time 2 Go Travel, LLC is not responsible for any loss resulting from cancellation, changes in gateways, schedule changes, itinerary changes, or travel date changes. Time 2 Go Travel, LLC may be unable to assist with schedule changes or delays related to air reservations made independently by Client.

It may not be possible to earn frequent flyer, hotel, cruise line, or other loyalty points for reservations included in Client’s itinerary. With limited exceptions, hotel, airline, or other rewards points cannot be redeemed for travel arrangements made by Time 2 Go Travel, LLC.

3. Client and Traveler Responsibilities

Client is responsible for:

  • Providing accurate personal information for all travelers
  • Reviewing all quotes, invoices, itineraries, confirmations, names, dates, destinations, and travel documents for accuracy
  • Making timely payments according to supplier and Agency deadlines
  • Meeting all passport, visa, vaccination, health, immigration, customs, and destination entry requirements
  • Ensuring travel documents match official identification exactly
  • Complying with all Supplier rules, deadlines, requirements, and policies
  • Purchasing or declining travel insurance or travel protection after considering the risks of travel

Any errors, denied boarding, denied entry, additional fees, cancellation, or loss resulting from inaccurate information, missed deadlines, missing documentation, or failure to comply with applicable requirements shall be Client’s responsibility.

4. Payment Terms

All prices are subject to change until paid in full and confirmed by the applicable Supplier. Client authorizes Time 2 Go Travel, LLC to charge the payment method provided for all approved travel arrangements, fees, deposits, and payments.

Some bookings may require nonrefundable deposits, final payments by specific deadlines, supplier-imposed penalties, or other restrictions. Failure to make timely payments may result in cancellation without refund.

Once processed, payments may be final, nonrefundable, or subject to Supplier policies. Time 2 Go Travel, LLC does not control Supplier refund timelines, Supplier penalty rules, or Supplier credit policies.

5. Chargebacks and Payment Disputes

Client must attempt to resolve any billing, refund, cancellation, or service concern directly with Time 2 Go Travel, LLC before initiating a credit card chargeback or payment dispute.

Client agrees not to initiate a chargeback or payment dispute for any reason related to Supplier cancellations, delays, schedule changes, Client’s personal decision to cancel, Client’s failure to meet documentation or entry requirements, dissatisfaction with Supplier services, Client’s decision not to purchase travel insurance, or any event outside the Agency’s control.

If Client initiates a chargeback or payment dispute in violation of these Terms, Client agrees to reimburse Time 2 Go Travel, LLC for all chargeback losses, fees, penalties, administrative costs, collection costs, and legal fees incurred by the Agency.

6. Cancellations, Changes, Delays, and Refunds

Client-initiated cancellations are subject to the cancellation terms and policies of each booking and Supplier. Client should refer to the individual booking, invoice, confirmation, proposal, or Supplier terms for applicable cancellation penalties, refund rules, credit rules, and deadlines.

Suppliers may change, delay, or cancel travel arrangements at any time. Time 2 Go Travel, LLC is not responsible for schedule changes, flight cancellations, weather disruptions, government actions, Supplier bankruptcy, Supplier default, Supplier failure, missed connections, service disruptions, or other circumstances outside the Agency’s control.

Refunds, credits, future travel credits, rebooking options, or compensation are determined exclusively by the applicable Supplier. Time 2 Go Travel, LLC does not guarantee Supplier performance, refunds, credits, or alternative arrangements.

The Agency is not responsible for environmental conditions at any destination, including but not limited to sargassum seaweed, red tide, algae blooms, beach erosion, ocean conditions, air quality issues, water quality issues, wildlife activity, odors, or other naturally occurring events affecting traveler experience.

7. Travel Insurance and Travel Protection

Travel insurance or travel protection is strongly recommended to protect against risks such as trip cancellation, trip interruption, medical emergencies, lost or delayed baggage, Supplier default, travel delays, illness, injury, and other unforeseen events.

Client is solely responsible for choosing to purchase or decline travel insurance. Clients declining travel insurance or travel protection assume all associated risks, including financial loss that may otherwise have been covered by a policy.

8. Documentation, Identification, and Entry Requirements

Client is responsible for obtaining and carrying valid passports, visas, health documents, vaccination records, entry permits, identification, and any other documentation required by Suppliers, governments, airlines, cruise lines, or destination authorities.

Passports should generally be valid for at least six months beyond return dates, unless a Supplier or destination requires a different standard. Client is responsible for verifying requirements for each destination and itinerary.

Names on travel documents must match official identification exactly. Time 2 Go Travel, LLC is not responsible for denied boarding, denied entry, cancellation, penalties, fees, or travel disruption due to missing, invalid, expired, inaccurate, or mismatched documentation.

9. Health, Safety, Environmental Conditions, and Travel Risks

Client confirms that each traveler is fit for travel and acknowledges that travel may involve exposure to illness, injury, communicable diseases, political instability, natural disasters, government restrictions, weather-related events, environmental conditions, and other risks beyond the control of Time 2 Go Travel, LLC or Suppliers.

Client acknowledges health risks, including communicable diseases such as COVID-19 and other illnesses, and releases Time 2 Go Travel, LLC from liability related to such risks to the fullest extent permitted by law.

Destinations may experience environmental conditions that affect the travel experience, including but not limited to sargassum seaweed, algae blooms, red tide, beach erosion, water quality conditions, wildlife activity, air quality issues, excessive heat, rain, drought, hurricanes, tropical storms, volcanic activity, smoke, odor, and other natural events.

Time 2 Go Travel, LLC makes no representation, warranty, or guarantee regarding beach, ocean, weather, environmental, health, safety, local, or destination conditions. Such conditions may impact beaches, swimming areas, excursions, resort amenities, visibility, odors, water clarity, or overall destination enjoyment and are beyond the control of the Agency.

No refund, credit, compensation, price reduction, or chargeback shall be available from the Agency due to environmental or destination conditions beyond the Agency’s control.

10. Destination Conditions Disclaimer

Client acknowledges that photographs, marketing materials, Supplier descriptions, online reviews, promotional content, and social media content may not reflect current conditions at a destination. Beach quality, water clarity, marine vegetation, wildlife activity, weather conditions, resort amenities, pool conditions, attraction availability, staffing, construction, maintenance, and local conditions may vary at any time.

Time 2 Go Travel, LLC is not responsible for dissatisfaction arising from such conditions and makes no guarantee regarding the condition, appearance, or usability of beaches, oceans, pools, attractions, resorts, amenities, or facilities.

11. Supplier Responsibilities

Time 2 Go Travel, LLC acts as an agent for third-party Suppliers and is not responsible for service failures, acts, omissions, negligence, delays, cancellations, schedule changes, substitutions, bankruptcy, financial default, or operational decisions of Suppliers.

The Company is not liable for delays, cancellations, missed connections, itinerary changes, denied boarding, lost or damaged baggage, personal injury, death, property loss, or financial loss caused by Suppliers or circumstances beyond the Agency’s control.

12. Assumption of Risk, Release of Liability, and Indemnification

Client voluntarily chooses to book travel services through Time 2 Go Travel, LLC and understands that all travel involves inherent risks, including delays, cancellations, Supplier changes, financial loss, illness, injury, and unforeseen events.

To the fullest extent permitted by law, Client releases and holds harmless Time 2 Go Travel, LLC, its owners, employees, independent contractors, and agents from any claims, losses, damages, liabilities, costs, or causes of action arising out of or related to Supplier actions or inactions, Client’s cancellation, Client’s failure to comply with requirements, Client’s failure to purchase travel insurance, events outside the Agency’s control, or travel risks assumed by Client, except where prohibited by law.

Client agrees to indemnify and defend Time 2 Go Travel, LLC against claims, damages, liabilities, fees, costs, and expenses brought by third parties or arising from Client’s actions, omissions, inaccurate information, failure to comply with requirements, or independently arranged travel.

13. Limitation of Liability

To the fullest extent permitted by law, the Agency’s liability is limited to the amount of commissions or service fees paid directly to Time 2 Go Travel, LLC for the booking at issue.

Time 2 Go Travel, LLC is not responsible for losses beyond its control, including Supplier negligence, Supplier failure, acts of God, force majeure events, missed connections, lost or damaged baggage, personal injury, death, weather disruptions, environmental conditions, or financial loss due to Supplier failure.

14. Force Majeure

No failure or delay in the performance of any obligation under these Terms will be a breach if that failure or delay arises from a force majeure event.

Force majeure includes, without limitation, governmental actions; fires; floods; storms; hurricanes; tropical storms; pandemics; epidemics; acts of God or nature; wars; terrorism; insurrections; riots; strikes; utility failures; failures of water, power, communications, or transportation systems; Supplier disruptions; environmental events; or any other cause beyond the reasonable control of Time 2 Go Travel, LLC or any Supplier.

If Agency or any Supplier is affected by a force majeure event, itineraries or arrangements may be varied, delayed, substituted, or cancelled. Unless otherwise required by applicable law or Supplier policy, Client remains responsible financially and otherwise for alternative travel arrangements, additional costs, and related expenses.

15. Dispute Resolution, Governing Law, and Venue

These Terms are governed exclusively by the laws of the State of Kansas, without regard to conflict-of-law principles.

The Parties will use reasonable efforts to resolve any dispute through informal direct communications before filing any formal claim.

If arbitration is required by a separate written agreement or mutually agreed to by the Parties, arbitration shall take place in Harvey County, Kansas, or through a mutually agreed remote process governed by Kansas law.

If the Parties are unable to resolve a dispute informally and the dispute is not resolved through arbitration, any claim arising from or relating to these Terms shall be brought exclusively in the state or federal courts serving Harvey County, Kansas. Neither Party will challenge such venue based on forum non conveniens or similar doctrine.

Neither Party will bring any legal action against the other Party as part of a class, collective, representative, private attorney general, or similar action.

Either Party may seek injunctive or other equitable relief to remedy any actual or threatened breach of these Terms.

16. Additional Legal Protections

Severability. If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted by law and the remainder of these Terms will remain in full force and effect.

Non-Disparagement. Client agrees not to make false or damaging statements about Time 2 Go Travel, LLC in public forums.

Confidentiality. Time 2 Go Travel, LLC will not disclose personal client information except as necessary to provide travel services, process bookings, comply with legal requirements, or with Client consent.

Attorney Fees. If legal action is required to enforce these Terms, the prevailing party may seek recovery of reasonable attorney fees and costs where permitted by law.

Client Acknowledgment of Risks. Client affirms understanding of travel risks and assumes responsibility for the decisions, documents, payments, insurance choices, and travel arrangements described in these Terms.

17. General Provisions

Amendments. These Terms may be amended only in writing by Time 2 Go Travel, LLC or by updated terms provided to Client with notice.

Assignment. Client may not assign any right or obligation under these Terms without Agency’s prior written consent.

Waiver. No forbearance or delay in enforcing these Terms will waive or restrict any rights. No waiver of one right will operate as a waiver of any subsequent right.

Relationship of Parties. These Terms do not create a partnership, joint venture, employment relationship, or authority for Client to bind Time 2 Go Travel, LLC.

Notices. Notices under these Terms will be in writing and deemed given when sent with receipt confirmation to the receiving Party’s email or other address provided for notice.

Acceptance. Client may confirm acceptance of these Terms in writing, digitally, electronically, by signature, clickwrap, sign-in-wrap, payment, approval of travel arrangements, or other active or passive electronic confirmation.

Conflicts. If any conflict arises between Supplier terms and these Terms, Supplier terms will control for Supplier products and services. If any conflict arises between these Terms and trip documentation issued by Time 2 Go Travel, LLC, these Terms will control unless the trip documentation expressly states otherwise.

Interpretation. Headings are for convenience only. The words include and including are without limitation. No text will be construed against either Party as author.

Termination. Termination will not affect either Party’s rights and obligations accrued but unsatisfied at termination, or any provision that by its terms or reasonable context should survive termination.

Further Assurances. Each Party will perform additional acts as reasonably necessary to carry out these Terms.

Entire Agreement. These Terms, together with any applicable travel client agreement, invoice, authorization, trip documentation, and Supplier terms, represent the entire agreement between the Parties regarding the subject matter.

18. Modifications

Time 2 Go Travel, LLC reserves the right to modify these Terms with notice to Client. Updates take effect upon notification, unless otherwise stated in writing.

19. State of California Requirements

If travel services or transportation is cancelled and the traveler is not at fault and has not cancelled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the traveler, all monies paid to the seller of travel for services not provided will be promptly paid to the traveler, unless traveler advises seller of travel in writing after cancellation.

In California, this provision does not apply where the seller of travel has remitted payment to another registered wholesale seller of travel or a carrier without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed upon transportation or service. In this situation, the seller of travel must provide the traveler with a written statement accompanied by bank records to establish the disbursement of the payment and, if disbursed to a wholesale seller of travel, proof of that wholesaler’s current registration.

20. Seller of Travel Disclosures

This Seller of Travel is not a participant in the California Travel Consumer Restitution Fund.

21. State of Washington Requirements

If transportation or other services are cancelled by the seller of travel, all sums paid to the seller of travel for services not performed in accordance with the contract between the seller of travel and the purchaser will be refunded within thirty days of receiving the funds from the vendor with whom the services were arranged, or if the funds were not sent to the vendor, the funds shall be returned within fourteen days after cancellation by the seller of travel to the purchaser unless the purchaser requests the seller of travel to apply the money to another travel product and/or date.

22. Host Agency Seller of Travel Credentials

Cornerstone Travel Seller of Travel Credentials: California Registered Seller of Travel CST 2158353-50. Registration as a seller of travel does not constitute approval by the State of California. Florida Seller of Travel Ref. No. ST-44927. Washington UBI #605 824 620.

23. Client Acceptance

By booking travel services through Time 2 Go Travel, LLC, signing this Agreement, clicking to accept, submitting payment, approving a quote or invoice, or otherwise proceeding with travel arrangements, Client acknowledges that Client has read, understands, and agrees to these Terms and Conditions, including the cancellation, chargeback, environmental conditions, liability waiver, limitation of liability, and travel insurance provisions.
